By browsing our website, engaging our services, or purchasing our products, you agree to be bound by these Terms.
Part A: IT Consulting, Custom Software & App Development
1. Scope of Work and Deliverables
All IT consulting, system architecture, custom software, and application development services will be defined in a specific Statement of Work (SOW), Work Authorization (WA), or invoice provided to the client prior to project commencement. Any additional features or scope changes requested after the SOW/WA/Invoice is signed will be billed at our standard hourly rate.
2. Intellectual Property Rights
Unless explicitly stated otherwise in a written agreement, Choyit Solutions retains all ownership and intellectual property rights to pre-existing code, frameworks, and tools used during development. Upon full payment of the project invoice, the client will receive a perpetual, non-exclusive license to use the final delivered custom software or application.
3. Limitation of Liability for Services
Choyit Solutions is not liable for any indirect, incidental, or consequential damages, including loss of data, business interruptions, or lost profits arising from the implementation or use of our IT or software solutions. Our total liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
Part B: Physical Product Sales
1. All Sales Final
Due to the nature of the items we sell—which frequently include high-value electronics and collectible trading card games (TCG) that are highly susceptible to market volatility and tampering—all physical product sales are strictly final. We do not accept returns, exchanges, or order cancellations for "buyer's remorse" or market price fluctuations after a transaction is processed.
2. Exception for Incorrect Items
The sole exception to our "All Sales Final" policy is if the item received does not match the item detailed on the invoice (e.g., incorrect electronic model or TCG set). In this event, you must contact us within 48 hours of delivery. The item must be returned in its original, sealed, untampered condition.
Every outgoing physical order is continuously video recorded. This unedited footage captures the item's pristine condition, factory seals, hardware serial numbers, the packaging process, the sealing of the shipping box, and the attachment of the shipping label. In the event of a dispute, chargeback, or claim of receiving damaged or tampered goods, this video evidence will be directly submitted to the payment processor, credit card issuer, and applicable shipping courier.
3. Shipping and Risk of Loss
All items are carefully inspected and securely packaged prior to shipment. The risk of loss and title for physical items passes to you upon our delivery of the item to the shipping carrier. We are not responsible for packages stolen from your porch or mailbox after the carrier marks them as "Delivered."
Part C: General Terms of Use
1. Acceptable Use
You agree not to use the Choyit Solutions website for any unlawful purpose or in any way that could interrupt, damage, or impair the functionality of the site. You may not attempt to gain unauthorized access to our servers, networks, or user data.
2. Third-Party Links
Our website may contain links to third-party websites or services that are not owned or controlled by Choyit Solutions (such as our Yamaware eBay storefront). We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.
3. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to your access to or use of the site or our services shall be instituted in a state or federal court in Washington State.
4. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate that changes have been made by updating the "Updated" date at the top of this page. Your continued use of the website after any such changes constitutes your acceptance of the new Terms.
